Malpractice and Maladministration Policy

1. Purpose

The purpose of this Malpractice and Maladministration Policy is to define and address instances of malpractice and maladministration that may occur within the operations of UK Learning Hub. This policy aims to ensure the integrity of assessment processes, maintain the reputation of the institution, and protect the interests of learners.

 

2. Definitions

2.1. Malpractice: Any intentional or unintentional action that undermines the integrity of the assessment process or compromises the validity and reliability of assessment outcomes.

2.2. Maladministration: Any administrative failure that results in the breach of regulations, policies, and procedures related to assessment and certification.

 

3. Types of Malpractice and Maladministration

3.1. Malpractice Examples:

3.1.1. Plagiarism and cheating during assessments.

3.1.2. Collusion between learners.

3.1.3. Impersonation during examinations.

3.1.4. Unauthorized access to assessment materials.

3.1.5. Fabrication or falsification of assessment evidence.

3.2. Maladministration Examples:

3.2.1. Failure to follow established assessment policies and procedures.

3.2.2. Errors in the administration of assessments.

3.2.3. Inadequate invigilation during examinations.

3.2.4. Failure to maintain the security and confidentiality of assessment materials.

3.2.5. Inaccurate recording and reporting of assessment results.

 

4. Prevention and Detection

4.1. Prevention Measures:

4.1.1. Clear communication of assessment policies and expectations to learners.

4.1.2. Implementation of robust authentication processes during assessments.

4.1.3. Regular staff training on malpractice and maladministration prevention.

4.2. Detection Measures:

4.2.1. Use of plagiarism detection tools for written assessments.

4.2.2. Random checks and audits of assessment processes.

4.2.3. Vigilance and awareness among staff to identify unusual or suspicious behaviour.

 

5. Reporting Procedures

5.1. Reporting Suspected Cases:

5.1.1. Staff members who suspect or witness malpractice or maladministration must report it to the designated authority promptly.

5.1.2. Learners are encouraged to report any observed instances of malpractice or maladministration.

5.2. Confidentiality and Protection: The identity of individuals reporting suspected cases will be kept confidential, and measures will be in place to protect them from victimization.

 

6. Investigation and Disciplinary Procedures

6.1. Investigation Process:

6.1.1. Prompt and impartial investigation of reported cases will be conducted.

6.1.2. A designated investigation team will gather evidence and interview relevant parties.

6.2. Disciplinary Measures:

6.2.1. Disciplinary action will be taken against individuals found guilty of malpractice or maladministration.

6.2.2. Sanctions may include, but are not limited to, warnings, re-assessment, suspension, or expulsion.

 

7. Appeals Process

Learners have the right to appeal against decisions made regarding allegations of malpractice or maladministration. An appeals process will be in place to address such cases.

 

8. Review and Continuous Improvement

This policy will be reviewed regularly to ensure its effectiveness and compliance with relevant regulations. Feedback from investigations and appeals will be used to enhance preventive measures continually.

 

This Malpractice and Maladministration Policy is effective as of 15/12/2023 and is applicable to all staff and learners associated with UK Learning Hub.
